Background

Floors 14 through 21 have been under renovation since early this summer of 2007. The Illinois Department of Public Health (IDPH) responded to information regarding the disturbance of greater than 3 lineal/square feet of Asbestos Containing Building Materials (ACBM). On August 3, 2007 IDPH performed an investigation and determined that ACBM, including friable insulation, had been disturbed within areas which were both likely and potentially to have caused asbestos fibers to become airborne presenting a risk of exposure to individuals entering the facility.

Based upon the notification of the Departments concern for the public welfare and the findings of non-compliant actions, building management secured the affected and potentially affected adjacent areas identified on floors 13 through 21 on August 3, 2007 and access has been restricted to entry by authorized personnel only to provide appropriate response investigations and corrective actions necessary to restore and ensure safe entry/re-occupancy.

The management of the Pittsfield Building is first concerned for the safety of its occupants and is fully cooperating with the regulatory Departments directives and requirements to initiate and implement timely and appropriate investigations and corrective action responses to meet and exceed that objective.

The management is also concerned for the inconvenience of those tenants who are unable to access their spaces at this time and assure that the foremost priority is to provide safe conditions for accessibility as soon as possible.

In order to achieve these objectives in cooperation with the Department and assistance of Inland Environmental Remedial Services, Inc. A detailed phased plan has been submitted to state officials by Inland incorporating the following of Response Actions

        1.   Ensure that extent of potential asbestos fiber extent of contamination is defined outside the Department designated restricted               floor areas for the safety of building occupants and implement immediate corrective actions should evidence of additional               contamination be found.

        2.   Determine the extent of contamination within restricted access of tenant occupied areas and initiate corrective actions as               necessary to provide clear access before proceeding with additional investigations and response actions.

        3.   Further investigate unoccupied renovation areas of designated floors to determine and properly remove asbestos               contamination and asbestos containing materials prior to the completion of additional renovations scheduled for further               developments at the property.
